Brazil’s Supreme Court Paralyzed as Judicial Feud and Banking Scandal Threaten Upcoming Elections

Brazil’s highest judicial body has plunged into a state of unprecedented internal turmoil, prompting Chief Justice Luiz Edson Fachin to halt regular court sessions for a second consecutive day. The rare suspension comes as explosive allegations of corruption, partisan bias, and police overreach threaten the credibility of the Supreme Court bench ahead of pivotal national elections.

Chief Justice Fachin took the extraordinary step on Thursday to cancel deliberations, instructing the judicial body to suspend its business until next Tuesday. Decisions to cancel scheduled hearings in this manner are exceptionally unusual for the high court, underscoring the severity of the institutional paralysis that has taken hold in the capital.

The acute institutional crisis first erupted into public view on September 1, when Justice Andre Mendonca made the controversial move to unseal confidential federal police documents. The files appeared to show Daniel Vorcaro, a disgraced banking executive at the center of a monumental fraud inquiry, seeking guidance and advice directly from fellow Justice Alexandre de Moraes.

The records disclosed under Mendonca’s authorization contained approximately 30 text messages that were allegedly dispatched by Vorcaro to a telephone number affiliated with de Moraes. The public unveiling of these private exchanges immediately ignited intense scrutiny regarding the nature of the communications between the senior magistrate and the embattled financier.

Justice de Moraes has stood as one of the most prominent and polarising legal authorities in Brazil over recent years. He gained international attention for presiding over the legal proceedings against former far-right President Jair Bolsonaro, who was convicted and handed a 27-year prison sentence for conspiring to orchestrate a coup following his 2022 electoral loss. De Moraes also drew fierce conservative backlash for enforcing suspensions of prominent digital platforms, including X and Rumble, due to noncompliance with judicial mandates.

Refusing to stay silent, de Moraes quickly launched a scathing counterattack against Mendonca, who was originally appointed to the court by Jair Bolsonaro. De Moraes alleged that his colleague was improperly abusing his judicial authority on the bench to score political points, while formally demanding an inquiry into allegations that Mendonca held an unauthorized interview with Vorcaro without prosecutors or police investigators present.

The internal feud is set to reach a dramatic climax when the full Supreme Court convenes on Tuesday. During the scheduled session, ten justices will assemble to formally deliberate and decide whether the eleventh member of the bench, de Moraes, must face an official investigation over the text messages linked to Vorcaro.

The bitter recriminations on the bench represent the expanding fallout from the massive Banco Master financial scandal. Vorcaro, the head of the private banking institution, was taken into custody by authorities in November 2025 over allegations that he orchestrated an elaborate scheme that defrauded investors of billions of dollars.

The subsequent collapse of Banco Master’s private banking division left behind more than $7bn in debt, marking it as one of the most catastrophic financial collapses in Brazilian history. In the months since, the investigation has widened significantly, pulling lawmakers and public figures from across the nation's political landscape into its orbit.

The escalating crisis at the nation’s top court arrives at a deeply sensitive moment, threatening to disrupt the high-stakes general elections scheduled for October. At the center of the political contest is a fiercely contested presidential race between incumbent left-wing President Luiz Inacio Lula da Silva and Senator Flavio Bolsonaro, the eldest son of the imprisoned former president.

As the controversy deepens, both President Lula and Senator Bolsonaro have seized on the tribunal's discord, publicly demanding comprehensive investigations into the conduct of the Supreme Court justices to ensure accountability.

The Bolsonaro political dynasty has found itself directly ensnared in the Banco Master web following an investigative report by the news outlet Intercept Brasil published in May. The report revealed that Senator Bolsonaro had personally approached Vorcaro to solicit commercial financing for a biographical film dedicated to his father, titled *Dark Horse*.

Senator Bolsonaro has adamantly maintained his innocence, defending his outreach to the banker as nothing more than a standard effort to secure legitimate private sponsorship for the cinematic project about the former head of state.

Tensions heightened considerably on Thursday as Brazilian law enforcement officers carried out dozens of coordinated raids across the country tied to the Banco Master case. Among the targets searched were key figures associated with the production of *Dark Horse*, specifically production company head Karina Gama and federal lawmaker Mario Frias, who served as an executive producer on the film.

Following the police operations, Senator Bolsonaro lashed out at the authorities, characterizing the raids and the surrounding inquiries as a calculated effort of political interference engineered to derail his campaign ahead of the autumn vote. With justices pitted against one another and politicians exchanging accusations of bad faith, the Supreme Court's paralysis reflects a broader battle testing Brazil's democratic institutions.
